Your Legal Rights as a Government Sector Employee
Under the U.S. Federal Labor Relations Authority (FLRA), Chapter 71 of Section 5 of the U.S. Code, each employee shall have the right to form, join, or assist any labor organization. To establish a union in your workplace, a majority of the workers must express support for the union
Once the union's election victory is certified by the Federal Labor Relations Board (FLRB), the employer is legally obligated to negotiate in good faith over hours and other working conditions. Wages are established by prevailing wages in the area, but other compensation (such as overtime, etc.) can be negotiated.
Your Legal Rights as a Private Sector Employee
You have the legal right under Section 7 of the National Labor Relations Act (NLRA) to join or support a union. To establish a union in your workplace, a majority of employees must express support for the union.
After the union's election victory is officially certified by the National Labor Relations Board (NLRB), your employer is legally required to negotiate in "good faith" with the union on a written contract covering wages, hours, and other working conditions.
